This Privacy Policy explains our practices regarding the collection, use, and disclosure of information that you (“you” or “User”) may provide to us through your use of our website hosted at https://lightcraft.pro (the “Website”), our Spark platform located at https://spark.lightcraft.pro (the “Platform”), our Spark mobile application (the “App”), our social media pages, and any other products or services that link to this Privacy Policy (collectively, our “Services”).

This Privacy Policy is incorporated into, and is part of, our Terms of Use available at https://lightcraft.pro/spark-terms-and-conditions (the “Terms of Use”) and our End User License Agreement available at https://lightcraft.pro/spark-eula (the “EULA”), which govern your access to and use of the Services. This Privacy Policy does not cover data or information we receive from third parties except as described herein, and it does not cover third-party products and services.

By accessing or using the Services, you agree to be bound by this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Services. Each time you use the Services, the current version of this Privacy Policy will apply. Accordingly, when you use the Services, you should check the date of this Privacy Policy (which appears at the top) and review any changes since you last reviewed it.

INFORMATION WE COLLECT

We collect two types of information from users of our Services: “Personal Information,” which is information that can be used to identify you (such as your name or email address), and “Aggregate Information,” which is information that cannot be used to identify you (such as frequency of visits to the Services and your browser type).

Information You Provide to Us

We collect Personal Information that you voluntarily provide to us when you use our Services. This includes, but is not limited to:

Account Information. When you create an account on the Services, we collect your email address, username, and password. You may also provide profile information such as your organization and job function. We support account authentication through Google single sign-on (“SSO”), Apple single sign-on, or a Lightcraft account.

User Content. We collect any information that you submit, or cause to be submitted, to the Platform or App. “User Content” includes project files, 3D assets, scene metadata, recorded video takes, and other materials that you upload, submit, create, or transmit through the Services. Each recorded take may include a user-editable device name and technical capture metadata (such as lens, exposure, and diagnostic data). User Content may also include communications, correspondence, and collaboration data shared through workspace features.

Payment Information. If you purchase a subscription through the Services, your payment card and other transaction-related information is collected and processed by Stripe, our third-party payment processor. Lightcraft does not have access to your full payment card details. We receive only tokenized customer references and transaction metadata (such as amount, plan, and status) from Stripe. We do not store card numbers or CVV on our systems.

Information We Automatically Collect

When you use our Services, we may automatically receive and collect certain information from your device. The specific information collected varies depending on whether you are using our Website, web-based Platform, or mobile App:

• Information about your device, such as the operating system, hardware, system version, Internet Protocol (IP) address, device ID, and device language.

• When you use our App, we automatically collect device model, operating system and version, and app usage data.

• We may infer your general (imprecise) location based on your IP address, such as your country, region, or time zone. We do not collect GPS or precise geolocation data.

• The specific actions that you take when you use our Services, including but not limited to the pages and screens that you view or visit and how you interact with our Services.

• The time, frequency, connection type, and duration of your use of our Services.

• Information regarding your interaction with email messages, for example, whether you opened, clicked on, or forwarded an email message.

• Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (as further described below).

• Pages you visited before or after navigating to our Services.

Information Generated by the Platform

Lightcraft generates certain data through the operation of the Platform (“Platform-Generated Data”), including usage logs, analytics, aggregated usage statistics, and technical performance data. Lightcraft owns all right, title, and interest in Platform-Generated Data.

Aggregate Information

Aggregate Information is information that does not identify you. Aggregate Information may be collected when you use our Services, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information such that only Aggregate Information remains. We may collect, use, store, and transfer Aggregate Information without restriction.

Without limitation of the above, Lightcraft may use de-identified and aggregated data derived from your use of the Services to improve the Platform’s functionality and performance. Lightcraft will not use your User Content to train artificial intelligence or machine learning models without your express consent.

Lightcraft generally does not intentionally collect sensitive personal information.

COOKIES, ANALYTICS, AND SIMILAR TECHNOLOGIES

Like most websites, our Services may use “cookies.” Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to help us identify you when you come to our Services. Our Services may use cookies for reasons including, but not limited to:

• Analyzing our web traffic using an analytics package.

• Identifying if you are signed in to the Services.

• Testing content on the Services.

• Storing information about your preferences.

• Recognizing when you return to the Services.

Overall, cookies help us provide you with a better website and better Services by enabling us to monitor which pages, functions, and features you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

Google Analytics and Google Tag Manager. We use Google Analytics and Google Tag Manager on our marketing website and Platform to measure website traffic, analyze user behavior, and understand how visitors engage with our content. These tools use cookies and similar technologies to collect information including your IP address, browser type, device information, pages visited, time spent on pages, and referring URLs. Google may also use this data to contextualize and personalize ads on its advertising network. TelemetryDeck. We use TelemetryDeck for product analytics on our Platform and mobile App. TelemetryDeck helps us understand how our Services are used and to improve their functionality. Interest-Based Advertising and Retargeting

We use interest-based advertising, also known as targeted advertising or ad retargeting, on our marketing website. This means we work with advertising partners to display advertisements to you on third-party websites and platforms based on your prior visits to our marketing website or your interactions with our marketing content.

When you visit our marketing website, advertising technologies such as cookies, pixels, and similar tools may collect information about your browsing activity. This information may include your IP address, browser type, device information, pages viewed, and the date and time of your visit. Our advertising partners may use this information to show you Lightcraft advertisements when you visit other websites or use other applications.

We do not use interest-based advertising on the Spark platform or mobile App. Interest-based advertising is limited to our marketing website.

Your Advertising Choices

You have choices regarding interest-based advertising. You can opt out of receiving interest-based ads from many advertising networks through the following industry tools:

Network Advertising Initiative (NAI): Visit networkadvertising.org/choices to opt out of targeted advertising from NAI member companies.

Many web browsers allow you to manage cookies and similar technologies. You can configure your browser to block third-party cookies or to alert you when cookies are being sent.

Please note that if you opt out of interest-based advertising, you may still see Lightcraft advertisements, but they will not be tailored to your interests based on your browsing history. Opting out does not mean you will stop seeing ads entirely.

GOOGLE AND APPLE SINGLE SIGN-ON

Our Services offer you the ability to register and log in using your Google account through Google single sign-on (“SSO”) or using your Apple account through Apple single sign-on. If you choose to register or log in using Google or Apple SSO, we will receive certain profile information from the applicable provider, which may include your name, email address, and profile picture, depending on your privacy settings with that provider. We use this information to create and manage your account on the Services.

MOBILE DEVICE ACCESS

When you use our mobile App, we may request access or permission to certain features on your device. Specifically, our App requests the following permissions:

• Camera. We request access to your device’s camera to enable augmented reality (AR) tracking and video recording features.

• Microphone. We request access to your device’s microphone to capture audio in recorded takes.

• Local Network. We request access to your local network to enable connection to a companion desktop application. When using this feature, your device’s personal name (such as “John’s iPhone”) may be broadcast over your local network to the paired desktop tool. This information is transmitted only over your local network and is not sent to Lightcraft’s servers.

If you wish to change our access or permissions, you may do so in your device’s settings.

PUSH NOTIFICATIONS

We may request to send you push notifications regarding your account, activity, or features of the Services. If you wish to opt out of receiving push notifications, you may turn them off in your device’s settings.

HOW WE USE YOUR INFORMATION

In general, we collect information and Personal Information from you so that we can provide our Services, operate our business, and provide information that you request from us. This includes but is not limited to the following:

• Provide, operate, improve, maintain, and protect our Services.

• Create and administer your account.

• Process your User Content, including project files, 3D assets, scene metadata, and video takes.

• Generate Platform-Generated Data, including analytics and usage statistics.

• Enable user-to-user communication

• Process purchases and payments.

• Provide you with technical and other support.

• Send you updates, marketing communications, and other information about Lightcraft and our Services.

• Send you notices and alerts.

• Conduct research, analytics, and monitor and analyze trends and usage.

• Contact you and respond to your inquiries.

• Enhance or improve user experience, our business, and our Services, including the safety and security thereof.

• Personalize our Services to you.

• As necessary to comply with any applicable law, regulation, subpoena, legal process, or governmental request.

• Enforce contracts, including investigation of potential violations thereof.

• Detect, prevent, or otherwise address fraud, security, or technical issues.

• Protect against harm to the rights, property, or safety of Lightcraft, our users, or the public as required or permitted by law.

HOW WE SHARE YOUR INFORMATION

Like most companies, we share information, including Personal Information, in certain circumstances with third parties through operation of our Services and our business. Below we explain when that happens.

Platform Users and Collaboration

If you use the Platform’s collaboration features, certain information may be visible to other users with whom you share workspaces or projects. This may include your name, profile information, and contributions to shared projects. You control with whom you share your workspaces and User Content.

Service Providers

We may transfer Personal Information to third parties for the purpose of providing the Services or operating our business. For example, we may transfer your Personal Information to third-party service providers to assist with cloud hosting and storage, analytics, payment processing, and communications providers.

Advertising Partners

We share information with advertising partners to deliver interest-based advertising on our marketing website as described in the “Interest-Based Advertising and Retargeting” section above. This may include sharing identifiers (such as cookie identifiers or hashed email addresses), browsing activity on our marketing website, and inferences about your interests. Our advertising partners may combine this information with data they have collected from other sources to deliver more relevant advertisements. We do not share information from the Spark platform or mobile App with advertising partners for interest-based advertising purposes.

Payments

If you purchase a subscription through the Services, your payment card and other transaction-related information is collected and processed by Stripe, our third-party payment processor. Lightcraft does not have access to your full payment card details.

Required Transfers

We may also transfer your Personal Information to third parties under the following circumstances: (i) to comply with a legal requirement, law, subpoena, judicial proceeding, court order, governmental request, or legal process; (ii) to investigate a possible crime, such as fraud or identity theft; (iii) in connection with the sale, purchase, merger, asset sale, financing, reorganization, liquidation, or dissolution of Lightcraft, including the evaluation thereof; (iv) when we believe it is necessary to protect the rights, property, or safety of Lightcraft or other persons; or (v) as otherwise required or permitted by law, including any contractual obligations of Lightcraft.

As Directed by You and With Your Consent

Except as otherwise provided in this Privacy Policy, we share Personal Information with companies, organizations, or individuals outside of Lightcraft only at your direction or when we have your consent to do so.

YOUR RIGHTS

In accordance with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country or state of residence.

Your Rights Regarding Personal Information

Subject to applicable law and depending on your state or country of residence, you may have the right to: (a) request access to and receive details about the Personal Information we maintain about you; (b) correct inaccuracies in your Personal Information; (c) request deletion of your Personal Information; (d) withdraw your consent to our processing of your Personal Information; and (e) receive a copy of your Personal Information in a structured, commonly used, and machine-readable format, and transmit that data to another controller (data portability). These rights may be limited in some circumstances by applicable law.

How to Exercise Your Rights. To submit a request to access, delete, or correct your Personal Information, or to withdraw consent, you may: (i) email support@lightcraft.pro; or (ii) log into your account and update your profile (for corrections).

Responding to Requests

We will respond to requests within a reasonable time frame. We may take steps to verify your identity before processing your request. We will not fulfill your request unless you have provided sufficient information for us to reasonably verify you are the individual about whom we collected Personal Information. If you have an account, we may use our existing account authentication practices to verify your identity. If you do not have an account, we may request additional information about you to verify your identity.

Marketing Communications

If you no longer wish to receive our marketing and promotional communications, you may opt out by following the instructions included in each communication.

RETENTION OF PERSONAL INFORMATION

We retain Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy, for as long as your account or your organization’s account remains active, or as needed to provide the Services. We will also retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable law), resolve disputes, enforce our agreements, and as otherwise described in this Privacy Policy.

When an organization’s account is terminated or deleted, User Content and project data associated with that organization are deleted. Individual user profile records may be retained for a reasonable period to support account recovery, prevent fraud, and comply with legal obligations, unless you submit a deletion request as described above. To enforce free trial eligibility and prevent abuse, we retain a one-way cryptographic hash of the email address associated with a deleted account. The email address itself cannot be recovered from that hash.

HOW WE PROTECT YOUR INFORMATION

We take the security of your Personal Information very seriously. We use reasonable administrative, physical, and technical safeguards to secure the Personal Information you share with us. Despite these safeguards and our additional efforts to secure your information, we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information.

CHILDREN’S PRIVACY

Our Services are not intended for use by children under the age of thirteen (13), and we do not knowingly collect Personal Information from children under the age of thirteen (13) in connection with the Services. If we learn that we have collected Personal Information from a child under thirteen (13), we will take steps to delete such information as soon as practicable.

EDUCATIONAL USERS

Some of our Services may be used by educational institutions. When our Services are used in an educational context, the educational institution is responsible for obtaining any required consents from students, parents, or guardians, and for ensuring compliance with applicable educational privacy laws, including the Family Educational Rights and Privacy Act (“FERPA”).

When we provide Services to educational institutions, we act as a “school official” with a “legitimate educational interest” under FERPA, meaning we use student information only for the purposes for which we were engaged by the institution. We do not use student Personal Information for targeted advertising. We do not sell student Personal Information.

If you are a student using our Services through an educational institution, please contact your institution’s administrator regarding any questions about your Personal Information or to exercise your privacy rights. If you are a parent or guardian with questions about your child’s use of our Services through a school, please contact the school directly.
